- Practical barriers such as delays obtaining birth certificates would complicate compliance, with critics warning the SAVE Act could disenfranchise 21 million Americans, disproportionately affecting married women and people who changed names, the Brennan Center for Justice says.
- Under current rules, the SAVE Act needs 60 votes to overcome a filibuster, but Senate aides report roughly 50 votes, and Senate Democrats vowed on Feb. 15 to block it, while President Donald Trump vowed on Feb. 19 to pass it `one way or another`.
- Policymakers and markets note the bill would eliminate many voter registration methods and currently has low odds of becoming law, with Polymarket and Kalshi betting markets assigning about 13% chance ahead of the 2026 midterm elections.
