Historic Native Title Ruling for Victorian Traditional Owners
VICTORIA, AUSTRALIA, JUL 18 – The Federal Court recognised exclusive rights for three First Nations groups to control access to parts of their traditional lands after a decade-long legal battle.
- On Friday morning, the Federal Court awarded the historic determination granting exclusive native title rights to the Latji Latji, Ngintait, and Nyeri Nyeri peoples, enabling control over their traditional lands.
- Since the 1990s, the Latji Latji, Ngintait and Nyeri Nyeri peoples have pursued recognition, leading to the 2015 native title claim, highlighting a decades-long legal process.
- Spanning thousands of square kilometres of the Mallee region, the ruling encompasses Kings Billabong, Hattah, Mildura, the Murray River, Calder Highway, and Murray-Sunset National Park, granting exclusive rights.
- Non-Traditional land users must now seek permission to enter these areas, while rights will be managed by the First People of the Millewa-Mallee Aboriginal Corporation and Tasmania and the ACT lack areas of exclusive native title status.
- Statewide, Indigenous Australians are celebrating the judgment as affirming pre-colonial laws and sovereignty, with Kaley Nicholson saying it established a 'legally undeniable truth known to thousands of generations of traditional owners.
