HHS Proposes Federal Rules to Restrict Gender-Affirming Care Funding for Minors
The U.S. Department of Health and Human Services proposes barring Medicare and Medicaid funding for gender-affirming care for minors, with $30 million spent federally in 2023.
- On Dec. 18, the Department of Health and Human Services announced sweeping restrictions on gender treatments for minors at an 11 a.m. press conference, with Health Secretary Robert F. Kennedy Jr. signing a declaration that such procedures do not meet professionally recognized standards.
- House Republican momentum helped prompt the move, as the Republican-led U.S. House of Representatives passed bills criminalizing gender-affirming care for minors and barring Medicaid reimbursement.
- Targeted rules would prohibit Medicaid reimbursement for patients under age 18 and block federal funding for hospitals providing pediatric gender-affirming care, CMS plans to propose.
- Supporters and opponents of transgender rights say the rules could make pediatric gender-affirming care extremely difficult, medical providers criticized the moves, and the rules will enter the Federal Register for public comment.
- Because virtually every hospital accepts Medicare, the federal action would have wide reach, while National Institutes of Health Director Dr. Jay Bhattacharya said NIH ended gender-related care research earlier this year and expects to terminate all by the end of 2025.
