HC Orders Takedown of Priety Zinta Deepfakes, Says Misuse of Such Content Affects Fundamental Rights

- On Wednesday, the Bombay High Court ordered the removal of all AI-generated deepfakes, morphed images, and unauthorized online content featuring actor Preity Zinta, holding that such misuse violates fundamental rights.
- Zinta, who has spent over 25 years in the film industry and appeared in over 40 films, approached the court after identifying nearly 275 YouTube links containing AI-generated, morphed, or superimposed videos using her likeness.
- Representing Meta, counsel stated the company has been taking "proactive steps" to remove such content, while the court reminded platforms of their due diligence obligations under the Information Technology Rules, 2021.
- "If the intermediaries start taking action, such type of offenders will stop," the court observed, warning that platforms contribute to violating fundamental rights protected under Articles 19 and 21 of the Constitution.
- Zinta joins celebrities including Arijit Singh, Akshay Kumar, Shilpa Shetty, Suneil Shetty, and Asha Bhosle who have secured similar relief, establishing precedent for protecting personality and moral rights against unauthorized AI-generated content.
