Former Ohio University Football Coach Files Lawsuit Alleging Wrongful Termination
The suit seeks the rest of Smith’s contract, plus interest and attorneys’ fees, after Ohio fired him for alleged misconduct.
On Friday, former Ohio University head football coach Brian Smith filed a wrongful termination lawsuit in the Ohio Court of Claims, alleging the university improperly fired him and damaged his coaching career.
University President Lori Stewart Gonzalez terminated Smith for cause on December 17, citing "participation in extramarital affairs," including with an undergraduate student, and alleged alcohol-related conduct.
Attorney Rex Elliott disputes the firing process, arguing the university rushed to judgment without a fair investigation. Smith allegedly did not know the individual was a student, and the relationship ended in early November.
The lawsuit seeks about $2.5 million—the full balance of Smith's contract through 2029—plus interest and attorneys' fees, claiming the university prioritized financial interests over contractual obligations.
Ohio University maintains the termination was based on violations of established employment terms, with a spokesperson calling the lawsuit unfounded and pledging the institution will strongly defend itself in court.
