- On Friday, former Staff Sergeant Damian Volk appeared in B.C. Supreme Court in New Westminster for a sentencing hearing on a single charge of assault stemming from a 2020 incident.
- The assault occurred on August 17, 2020, when Volk took handcuffed Dalibor Kuzmanovic to the ground and delivered a backward kick to his head during a booking at Langley RCMP detachment cells.
- Crown prosecutor Cory Lo requested three months of jail time, arguing that "it's the breach of trust and the abuse of authority," emphasizing officers must respect rights of those in their care.
- Defence lawyer Danielle Ching McNamee sought a conditional discharge, proposing 18 to 24 months of probation and 50 hours of community service, citing Volk's PTSD diagnosis and the assault's "heat of the moment."
- Justice John Gibb-Carsley, who found Volk was not in objective danger and should not have resorted to violence, is expected to deliver the final sentence on July 10 of this year.
