Former B.C. chiropractor appeals sexual assault conviction
The appeal could send the case to a new trial, forcing the complainant to testify again, while the Crown had sought five months in jail.
Former Vernon chiropractor Murray Kievit is appealing his sexual assault conviction, with proceedings scheduled for Monday, June 1, at the Vernon Law Courts in the B.C. Supreme Court.
Justice David Ruse convicted Kievit of sexual assault on Feb. 2, following a Jan. 14 sentencing in Provincial Court that imposed a nine-month conditional sentence and three years of probation.
The original trial examined whether touching the complainant's pubic area during a 2021 chiropractic treatment was legitimate, a claim Crown prosecutor Catherine Rezansoff disputed while seeking five months in jail.
A successful appeal could result in another trial requiring the complainant to testify again, though Justice Ruse previously sided with the defence by imposing house arrest over jail time.
Records show Kievit was acquitted of similar charges in 2000, though the B.C. College of Chiropractors issued a $4,000 fine and $15,000 in costs; those needing support can contact the Archway Society for Domestic Peace.
