- Fifth Amendment violations led Hinderaker to rule the deportation "unlawfully" inflicted "irreparable harm" on Soliman, rejecting the government's argument that blanket "diplomatic assurances" from Equatorial Guinea regarding detainee safety constituted sufficient due process.
- With 30 days to appeal the ruling, the Department of Homeland Security must also provide the court with a status report every three days detailing Soliman's current condition and the agency's progress in facilitating his return.
