Federal judge issues new nationwide block against Trump’s order seeking to end birthright citizenship
CONCORD, NEW HAMPSHIRE, JUL 11 – The court certified a nationwide class action protecting millions of children born in the U.S. to immigrant parents from losing citizenship under the blocked executive order.
- On July 10, U.S. District Judge Joseph Laplante in Concord, New Hampshire granted class-action status and issued a nationwide injunction blocking Trumps enforcement of birthright citizenship, with a seven-day stay for appeal.
- Issued on Jan. 20, President Donald Trump’s executive order Protecting the Meaning and Value of American Citizenship directs agencies to deny citizenship to U.S.-born children of noncitizen parents.
- In his remarks from the bench, Judge Laplante called depriving citizenship `irreparable harm`, called it `the greatest privilege that exists in the world`; he then stayed the injunction for seven days to allow an appeal.
- Attorneys for the Department of Justice called the relief too broad and premature, and the Department of Justice previously suggested it would appeal the ruling.
- With the ruling in place, babies born on U.S. soil remain protected under the Constitution, and legal analysts say the case could return to the Supreme Court.
