The Federal Constitutional Court repealed the Triage rules in the Infection Protection Act. Doctors had successfully sued: the Federation had no legislative competence and the rules violated the professional freedom of doctors.
If there is no room in a crisis in intensive care units, doctors must decide who is being treated and who is not. Three years ago, rules were laid down in Germany, but they are not constitutional.
If intensive beds are too scarce, clinics must prioritize the allocation. However, the legal requirements are not in accordance with the basic law, the Constitutional Court finds.
