Employment – Discrimination – Age and Disability

Where a plaintiff has filed a G.L.c. 151B complaint, a motion by the defendant employer and a codefendant manager to dismiss the complaint should be denied except with respect to the plaintiff’s age discrimination claim, as the manager’s alleged comment that the employer was “looking for someone with less miles on them” does not give rise to a reasonable inference of age-related discriminatory animus.
