'Toilet police' not expected over single-sex space guidance, equality boss says
The EHRC advises businesses to limit single-sex spaces to biological sex and suggests unisex facilities to balance rights after the UK Supreme Court ruling, affecting services nationwide.
- On Sunday, EHRC chair Dr Mary-Ann Stephenson said a leaked draft seen by the BBC, passed to the UK government three months ago, says single-sex spaces should be limited to biological sex, adding `Nobody is expecting there to be a toilet police`.
- Following the April decision, the EHRC drafted guidance to help businesses and services such as women's refuges, gyms, hospitals, and shopping centres apply the Supreme Court ruling defining a woman by biological sex under the Equality Act 2010.
- Guidance recommends asking for confirmation `by proportionate means` and converting two self-contained cubicles labelled by sex into unisex rooms where feasible.
- Monday's tribunal found NHS Fife `harassed` Sandie Peggie, and some transgender campaigners expressed anger over the draft guidance, while a remedy hearing is scheduled.
- Stephenson said the Peggie ruling highlights the importance of single-sex spaces for some women, but stressed trans people need alternative services while she enforces the Equality Act's sex-based definition.
