Environmental Groups Appeal xAI Air Permit

MEMPHIS, TENNESSEE, JUL 17 – The NAACP and environmental groups claim the methane turbines emit pollutants worsening health risks in a majority-Black Memphis neighborhood, challenging the permit under the Clean Air Act.

  • On July 15, the Southern Environmental Law Center representing the NAACP and Young, Gifted & Green appealed a Shelby County Health Department permit allowing xAI to run up to 15 turbines at its Memphis data center.
  • When xAI first began operations in Memphis last year, it installed temporary turbines deemed too small for permits and ran up to 35 generators in a polluted, majority-Black neighborhood.
  • The Southern Environmental Law Center warns turbines could emit thousands of tons of nitrogen oxides and formaldehyde, heightening cancer risk and worsening air quality in majority-Black neighborhoods.
  • On Wednesday, xAI responded to the appeal by saying it was `disheartened `, calling it a `baseless, politically driven appeal` and affirming it will comply with all laws.
  • NBC News reports the intent-to-sue notice gives xAI 60 days to address environmental concerns, and if the NAACP succeeds, it could reshape permitting processes nationwide.
