Eligibility of Wisconsin's Nyzier Fourqurean in Question
WISCONSIN, JUL 16 – The Seventh Circuit ruled that NCAA's five-year eligibility rule does not unlawfully restrict athlete participation, reversing a lower court's injunction for Wisconsin's Fourqurean.
- On Wednesday, a federal appeals court reversed a lower court's decision that had temporarily allowed Wisconsin cornerback Nyzier Fourqurean to extend his NCAA eligibility by an additional year.
- This change came after the NCAA challenged a lower court’s decision, following Fourqurean’s contention that his initial two years playing at Grand Valley State, a Division II school, should not be included in calculating his eligibility.
- Fourqurean, a fifth-year senior who joined Wisconsin two seasons ago, had previously obtained an injunction from Judge William Conley and testified in February that playing this season would allow him to earn substantial income through opportunities related to his name, image, and likeness rights.
- The 2-1 appellate decision found Fourqurean’s claim relies solely on him not playing the upcoming season, ruling there is no unreasonable restraint of trade while the NCAA expressed thanks for the reversal and pledged continued support for athletes.
- As the August 28 season opener against Miami approaches in just over six weeks, Fourqurean’s future remains uncertain, and despite being expected to start, his chances of playing this year appear slim.
