Driver who killed four-year-old after 'ramming' car following drinking session cleared of murder
Owen and Patrick Maughan pursued a family vehicle while intoxicated, leading to a crash that killed 4-year-old Peter Maughan and left another man paralysed, court heard.
- On Thursday , the jury at Maidstone Crown Court cleared both men of murder after more than 17 hours of deliberation, while Owen Maughan, 27, had pleaded guilty to manslaughter.
- Video filmed by Hayley Maughan shows the confrontation developing as the vehicles travelled on the A2, after the men had been drinking in Rochester and during a phone threat saying 'I'm going to ram them.'
- At about 60mph, Owen Maughan clipped the pick-up, causing it to rotate and roll up to three times with a child's pushchair wedged under the vehicle, court hears.
- Judge Oliver Saxby KC remanded both defendants and said he needed more background information before passing a likely lengthy sentence, thanking the jury for their care in an upsetting case.
- The judge instructed jurors that murder required them to be 'sure' Owen intended serious harm, while defence counsel argued his act was a 'split second' choice without direct evidence of intent.
