The Supreme Court ruled menstrual health is a fundamental right and mandated free biodegradable pads and hygiene facilities in all Indian schools for adolescent girls.
- On Friday, the Supreme Court of India ruled menstrual health falls under Article 21 and 21A, directing states and Union Territories to provide free sanitary pads in private and government schools.
- A public interest petition filed on December 10, 2024 by Jaya Thakur sought pan-India implementation of the Union government's Menstrual Hygiene Policy for School-Going Girls targeting Classes 6-12 in government and government-aided schools.
- The court ordered schools to set up menstrual hygiene management corners stocked with spare innerwear, uniforms, disposable pads and required sanitary waste disposal measures.
- All schools must now provide functional gender-segregated toilets with water connectivity catering to students with disabilities; private schools face de-recognition for non-compliance, and state governments and Union Territories are accountable, the bench said.
- The ruling positions national policy implementation across urban and rural schools, directing government and private schools for Classes 6-12 to follow the Menstrual Hygiene Policy and requiring state and school authorities to overhaul procurement, infrastructure and sanitation practices.
