- The Socio-Economic Rights and Accountability Project filed the suit in August 2023 following public outcry, as the spending plan emerged shortly after the 10th Assembly's inauguration amid deepening economic hardship triggered by petrol subsidy removal.
- Bogoro held that lawmakers, as beneficiaries of the approved expenditure, placed themselves in a conflict of interest, finding the spending breached the Public Procurement Act's competitive bidding requirements and violated their constitutional oath of office.
- The court ordered Senate President Godswill Akpabio and Speaker Tajudeen Abbas to ensure all future National Assembly expenditures comply with due process and transparency principles, while SERAP urged immediate implementation to strengthen public confidence.
- This ruling follows a history of civic pushback, including a 2016 suit challenging procurement of 108 Toyota Land Cruiser vehicles, and was welcomed by human rights lawyer Femi Falana, a Senior Advocate of Nigeria, as confirmation that lawmakers cannot justify extravagant spending during hardship.
