Federal judge blocks bans on SNAP use for soda
The ruling affects at least 18 states and says USDA exceeded its authority and skipped required public notice.
On Monday, a federal judge struck down USDA approval of Supplemental Nutrition Assistance Program waivers in five states, ruling the agency exceeded its authority by barring purchases of soda, candy, and energy drinks.
Health Secretary Robert F. Kennedy Jr. and Agriculture Secretary Brooke Rollins championed the initiative to strip foods regarded as unhealthy from the $100 billion federal program, which serves 42 million Americans.
Indiana, Iowa, Nebraska, Utah, and West Virginia were among at least 18 states that enacted these waivers before the court's intervention blocked the restrictions.
The court ruled the USDA violated its own guidelines by failing to provide required public notice before implementing the restrictions, rendering the approvals invalid.
It remains unclear whether the USDA or participating states will appeal the decision, as Nebraska officials await federal guidance on whether to continue or abandon the restrictions.
