Conservatives introduce bill to create ‘stand your ground’ law for home invasions
Bill C-270 aims to presume homeowner force reasonable during intrusions, responding to a 123% rise in violent crime in York Region, advocates say.
- On Thursday, Newmarket-Aurora MP Sandra Cobena introduced Bill C-270, the Stand on Guard Act, which would amend the Criminal Code to presume force used against home intruders is reasonable unless evidence proves otherwise.
- The Conservative Party announced a 'stand on guard' principle last August, calling for legislative changes. Cobena cited rising crime in York Region, where robberies increased 119 percent since 2015, as a driver for the bill.
- Proponents cite the 2019 Collingwood case of Cameron Gardiner, who was arrested after shooting an intruder and spent six months in jail before charges were dropped. Cobena argues "right now, the onus is on the homeowner" causing costly legal battles.
- Justice Minister Sean Fraser noted on Thursday that Canadians already possess the right to reasonable force. McGill University law professor Noah Weisbord labeled existing laws "extremely permissive," questioning what the bill would practically accomplish.
- Grassroots Conservative supporters voted for a "castle law" policy in January, signaling strong internal party backing. The initiative builds on 2013 Criminal Code reforms that scholars say already made claiming defensive force easier than in the United States.
