CFTC Submits Crypto Market Framework for White House Review
The filing starts executive review of a proposed crypto market structure rule that could expand CFTC oversight if Congress remains stalled.
On Sept. 17, The Commodity Futures Trading Commission submitted a rule titled "Regulation Crypto Asset Transactions and Regulation Crypto Asset Markets" to The White House for Office of Information and Regulatory Affairs review.
The filing follows The Senate's failure to pass the Digital Asset Market CLARITY Act, as the procedural vote ended 49 to 50, falling short of the 60 votes required for debate.
CFTC Chairman Michael Selig had previously directed staff to "codify a CFTC market structure for crypto assets" using existing agency powers, preparing for the possibility that Congress would not complete federal legislation.
Alongside the submission, CFTC staff issued no-action relief for software developers on Sept. 17, while The SEC continues its own crypto rulemaking agenda for tokenized markets.
Seven Senate Democrats who opposed the procedural vote suggested negotiations could continue, though Congress remains divided over federal market structure laws, leaving agencies to fill the regulatory void.
The CFTC sent a proposal for regulating crypto transactions and markets to the White House for review, just two days after the Senate blocked the procedural progress of the CLARITY Act. The plan is not yet a current standard, but it opens a new avenue of action for the agency as legislative negotiations continue.
