Case against Nevada 2020 fake electors dismissed
Judge Mary Kay Holthus said prosecutors failed to show the six Republicans meant to mislead officials, and the state plans to appeal.
Nevada Judge Mary Kay Holthus dismissed the case against Nevada Republicans on Friday, ruling the state lacked evidence that the electors intended to deceive government officials.
After the 2020 election, six Republican electors gathered outside the Nevada Legislature to sign a certificate awarding the state's electoral votes to Donald Trump, even though Joe Biden won by over 30,000 votes.
State Attorney General Aaron Ford brought charges of forgery and "offering a false instrument for filing or record" against the defendants, who described their actions as "political theater."
Ford plans to appeal the ruling, The Associated Press reported, though three other fake elector cases in Arizona, Michigan, and Georgia have also been dismissed.
Prosecutors argued the defendants intended for their documents to be mistaken for official electoral votes that then-Vice President Mike Pence would count on Jan. 6, 2021, but Holthus found insufficient evidence.
