Carmakers Score Major Victory in UK Dieselgate Emissions Trial
- On Friday, the High Court ruled that major car manufacturers including Mercedes-Benz, Renault, Nissan, Ford, and Peugeot and Citroen largely avoided liability over alleged "prohibited defeat devices" in diesel vehicles.
- More than 1.6 million motorists brought 13 groups of lawsuits, with 880,000 claimants alleging that 20 sample vehicles contained prohibited defeat devices designed to manipulate emissions test results.
- Lady Justice Cockerill rejected most allegations, stating that a prohibited device requires an "intentional and/or impermissible purpose" to alter emissions control systems when the vehicle senses it is being tested.
- Though the court rejected most claims, it found against one Mercedes device and one in Peugeot-Citroen vehicles; lawyers for the claimants said they are considering an appeal based on a "significantly narrower interpretation of the law."
- A further trial is scheduled for October this year to determine consequences of any breaches and address potential damages, following the 2015 "Dieselgate" scandal involving 11 million vehicles that cost manufacturers billions in fines.
