California workers say Newsom’s return-to-office order is environmentally illegal

- California Attorneys, Administrative Law Judges and Hearing Officers in State Employment is attempting to block Governor Gavin Newsom's return-to-office mandate, citing a 56-year-old environmental law. The union represents 5,000 state workers.
- On May 27, CASE sent letters to more than 100 state agencies demanding an environmental impact review. The union argues the order will require "hundreds of thousands of additional monthly commutes," increasing automobile tailpipe pollution.
- Enacted in 1970 by former Governor Ronald Reagan, the California Environmental Quality Act requires agencies to evaluate environmental consequences. While traditionally used for construction projects, CASE argues commuter environmental impacts require the same review process.
- The governor's office maintains the order is not directly subject to CEQA, contending it is not a public agency project. Union vice president Matthew Gauger told The Merced Sun Star they "expect to be very successful" in forcing a review.
- This challenge follows a previous one-year postponement after intense union pushback in 2025. Conducting the mandated review could again delay the requirement, though Newsom maintains the policy improves collaboration, accountability, and efficiency.
