Brittany Higgins Faces Bankruptcy Action by Former Boss
Linda Reynolds seeks to enforce a defamation judgment exceeding $1 million after Brittany Higgins failed to comply with a bankruptcy notice over social media allegations.
- On Monday, former defence minister Linda Reynolds filed a creditor's petition in the Federal Court, launching bankruptcy proceedings against Brittany Higgins after being awarded more than $1m in defamation damages and legal costs.
- After failing to comply with a bankruptcy notice issued several weeks ago, Brittany Higgins was ordered by the Western Australian Supreme Court to pay $315,000 plus interest and 80 per cent of Linda Reynolds's legal costs.
- Justice Paul Tottle found the $200,000 settlement offer unreasonable and recorded Higgins's attempt to cap lawyer fees at $781 per hour, which Reynolds opposed.
- Following Monday, Linda Reynolds confirmed she filed a creditor's petition in the Federal Court, and the case is listed for a WA registrar hearing in November, as Reynolds said `It is unfortunate that I have to take this step in this long-running saga.`
- The bankruptcy filing adds a financial dimension to a wider legal saga that includes Higgins's rape allegation against Bruce Lehrmann and a Federal Court judge's finding on the balance of probabilities.
