B.C. teachers antisemitism group loses bid to fast-track complaint hearing
Justice Michael P. Klein said the tribunal’s refusal was not patently unreasonable and that the petitioner had not shown ongoing harm.
- On May 15, Supreme Court Justice Michael P. Klein issued a decision in Vancouver, dismissing an application by Teachers Against Antisemitism to review a Human Rights Tribunal ruling regarding their complaint against the Federation.
- Following the Oct. 7, 2023, attack on Israel by Hamas, the group alleged the Federation "acted in a discriminatory and antisemitic manner" and "tolerated, allowed, enabled, and actively promoted discrimination" against Jewish, Zionist, and pro-Israel members.
- Seeking faster resolution, Teachers Against Antisemitism applied to fast-track the complaint in 2025, but the Tribunal denied the request, stating it "does not mean that the complaint will languish in the Tribunal's process."
- Justice Michael Klein ruled the previous Tribunal decision was not "patently unreasonable," rejecting the group's bid to bypass standard procedures despite acknowledging significant backlog at the Tribunal.
- The Federation has a pending application to dismiss parts of the complaint while it proceeds through the Tribunal, with all parties acknowledging the process may take years to conclude due to backlog.
