Attorneys for Wrongly Deported Venezuelan Asylum Seeker Will Seek Criminal Contempt Proceedings After Prisoner Swap
VENEZUELA, JUL 22 – Lawyers plan to seek criminal contempt charges against the Trump administration for violating court orders after deporting a Venezuelan asylum seeker to a prison in El Salvador.
- Last week, Cristian returned to Venezuela in a prisoner swap, with Venezuela releasing 10 U.S. citizens for 252 deportees.
- Earlier this year, US District Judge Stephanie Gallagher found his March deportation violated a settlement protecting young migrants with pending asylum claims; she ordered the government to facilitate his return to the US.
- Seeking criminal contempt, Kevin DeJong told the court, noting they will file a request within 10 days for egregious violations of the settlement agreement.
- Ruth Ann Mueller argued the government claimed compliance, while Judge Gallagher said she saw no evidence of efforts to send Cristian directly to the U.S.
- In upcoming days, attorneys will seek sanctions, while Gallagher ordered the government to file weekly status reports.
