Arkansas Man Accused of Threatening Massachusetts Members of Congress Faces Federal Charges
David Czerniak faces two counts after prosecutors said he left voicemails threatening lawmakers over immigration policy.
On Wednesday, federal authorities arrested 62-year-old David Czerniak of Hatfield, Arkansas, after a federal grand jury indicted him on two counts of interstate transmission of threatening communications targeting two unnamed Massachusetts members of Congress.
Czerniak allegedly left threatening voicemails at congressional offices in February and December 2025, citing grievances over immigration and border policies while warning lawmakers and their families would "pay the consequences."
During these calls, he referenced the 1995 Oklahoma City bombing by Timothy McVeigh and the assassination of Charlie Kirk, telling officials to "better watch your back" before podiums.
U.S. Attorney Leah B. Foley stated threats against elected officials "are not protected speech" but "federal crimes," while the FBI emphasized political disagreements must never escalate into violence.
If convicted on both counts, Czerniak faces a maximum five years in prison per count, three years of supervised release, and a $250,000 fine, with trial proceedings set for Boston federal court.
