Appeals court rules Trump clamp-down on spending data defies Congress’ authority
DISTRICT OF COLUMBIA, AUG 10 – The court ruled Trump’s attempt to conceal federal spending data violates constitutional disclosure laws and set an Aug. 15 deadline to restore the database online, the D.C. Circuit panel said.
- Unanimously voting on Saturday, the three-judge panel of the D.C. Circuit Court of Appeals ordered the Trump administration to restore the database by August 15, rejecting its stay request.
- In March of this year, the Executive disabled the public spending database after arguing that disclosure could interfere with presidential management of federal funds.
- Writing in a forceful opinion, Henderson, a George H.W. Bush appointee, rejected the administration’s rationale, stating, `Only Congress—not the administration—could decide to shut down the database.`
- Last month, U.S. District Judge Emmet Sullivan ordered data restoration, but Saturday’s appeals court ruling ends that pause, requiring the OMB to release withheld information since March.
