Alberta judge concerned about parts of ruling that threw out separatist petition
Justice Alice Woolley said parts of the lower-court ruling raise concerns as Alberta separatists seek to revive a petition with about 301,000 signatures.
Alberta Court of Appeal Justice Alice Woolley reserved her decision yesterday on whether to stay a lower court ruling that quashed a separatist group's referendum petition.
The Stay Free Alberta group submitted a petition in May with nearly 302,000 names, but Court of King's Bench Justice Shaina Leonard tossed the measure last month, ruling the government neglected its duty to consult First Nations.
Lawyer Jeff Rath argues for a stay to allow Elections Alberta to verify signatures, while Premier Danielle Smith cites both this petition and a pro-Canada petition with 404,000 signatures as justification for the Oct. 19 referendum.
Expressing unease with aspects of Leonard's interpretation of legislative changes, Woolley noted her concerns do not signal how she will rule on the appeal.
The upcoming Oct. 19 referendum asks Albertans whether they want to remain in Canada or hold a second, binding vote on separation in the future.
