Oklahoma AG Files New Lawsuit Against State Farm, Accuses Insurer of Denying or Underpaying Claims
Drummond says the insurer used undisclosed standards and a hail program to reduce approvals and minimize payments for Oklahoma policyholders.
- On Friday, Oklahoma Attorney General Gentner Drummond filed a new lawsuit against State Farm Fire and Casualty Company, accusing the insurer of using deceptive practices to underpay wind and hail damage claims.
- The lawsuit follows a Tuesday ruling by the Oklahoma Supreme Court that blocked Drummond from intervening in a private case involving Billy and Lacy Hursh over a denied roof claim.
- According to the lawsuit, State Farm allegedly used an internal program called the "Hail Focus Initiative" to reduce replacement approvals and minimize payments to policyholders under the Oklahoma Consumer Protection Act.
- "This case is about more than individual claim disputes," Drummond stated, arguing the alleged scheme threatens the integrity of Oklahoma's insurance marketplace and undermines public confidence in the industry.
- Seeking relief under the Oklahoma Racketeer-Influenced and Corrupt Organizations Act, Drummond aims to stop what he describes as "massive fraud" against homeowners, addressing the widening gap between rising premiums and diminishing protections.
