- The group will spend $13 million on state Supreme Court, secretary of state, and legislative races in Michigan, Montana, North Carolina, Georgia, Arizona, and Nevada. An additional $12.5 million supports ballot measure campaigns in Kansas, Missouri, Montana, and Virginia.
- Targeting a "roughly 14%" chunk of the electorate known as the "ACLU Sway," the organization aims to mobilize voters beyond its traditional base. Schifeling noted this group includes libertarian-leaning men and older white women.
- This campaign seeks to build lasting "constitutional infrastructure" to block efforts to restrict reproductive and voting rights, with the ACLU intending to protect state courts from politicized judicial selections throughout 2026.
