According to the decision published in the Official Gazette, an exception has been made regarding condominium ownership and easement rights for certain tourism facilities located in areas designated solely for commercial use in the zoning plan before June 1, 2019.

With the amendment to the Regulation on the Qualifications of Tourism Facilities, an exception regarding condominium ownership and easement rights has been introduced for some tourism facilities located in areas designated solely for commercial use in the zoning plan before June 1, 2019.

For establishments registered as tourism businesses or partial tourism businesses, and located in areas designated solely for commercial use in the zoning plan prior to June 1, 2019, the condominium ownership and easement rights in the accommodation units belonging to the same owner will be preserved.

With the amendment to the regulation concerning tourism facilities, an important exception has been introduced for businesses meeting certain conditions. In tourism businesses and facilities with partial tourism business certificates located in areas designated solely for commercial use in zoning plans before June 1, 2019, the condominium ownership and easement rights on accommodation units belonging to the same owner will be preserved.

In tourism-certified facilities that were designated as commercial areas in the zoning plan before June 1, 2019, the condominium ownership and easement rights in the accommodation units belonging to the same owner will be preserved. The new regulation exempts these facilities from certain restrictions.
