Judge blocks Trump from firing federal workers during government shutdown for now
- On Wednesday, Judge Susan Illston of the U.S. District Court for the Northern District of California granted a temporary restraining order pausing reductions-in-force at more than 30 federal agencies.
- The unions filed suit after the Office of Management and Budget issued a memo urging agencies to use the funding lapse for layoffs, which plaintiffs say misinterprets the Antideficiency Act.
- On Friday, at least seven agencies sent RIF notices to more than 4,000 federal employees, with nearly 800 erroneous Department of Health and Human Services notices and CDC reversals.
- Illston ordered the administration to file by Friday an accounting of layoffs under her temporary restraining order and set a follow-up hearing for Oct. 28 to consider an indefinite pause.
- Judge Illston's prior ruling in May found that `agencies may not conduct large-scale reorganizations and reductions in force in blatant disregard of Congress's mandates` and emphasized presidential limits, relevant to the current dispute.
