MUMBAI, MAHARASHTRA, INDIA, JUL 24 – The Supreme Court stayed the acquittal citing potential impacts on ongoing organized crime trials under Maharashtra Control of Organised Crime Act, while 12 accused remain free after nearly 19 years.
- On Thursday, July 24, the Supreme Court of India stayed the Bombay High Court’s acquittal of 12 men, allowing them to remain free pending appeal.
- The Bombay High Court noted the ATS failed to prove the offences beyond a reasonable doubt, ruled confessional statements were obtained through `barbaric and inhuman` torture, and invalidated identification parades due to procedural lapses.
- His mother, Husna Bano Bashir Khan, lamented, `More than half of our lives are gone.` after Asif Khan walked out of Pune’s Yerwada jail on July 21, reuniting with his family in Jalgaon.
- The Supreme Court clarified the stay will not send the men back to prison, the bench said the judgment won’t set precedent and Solicitor General Tushar Mehta argued it shields other MCOCA trials.
- The Supreme Court will hear the Maharashtra government’s appeal on July 24 before Justices M.M. Sundresh and N. Kotiswar Singh, with Solicitor General Tushar Mehta warning these legal findings could affect all MCOCA trials.
