- The Zenith Labour Party had challenged Sections 77 and 84 of the Electoral Act at the Federal High Court in Abuja, arguing these provisions interfered with internal party management and candidate selection.
- Judge Adamu Jauro led the seven-member panel in holding the provisions consistent with the Nigerian Constitution, reinstating the Federal High Court judgment and awarding N2 million costs against the ZLP.
- Political parties must now adhere to statutory requirements regarding membership registers, submitting them to INEC at least 21 days before primaries or risk being unable to field candidates.
- Although political parties have already conducted primaries for the 2027 elections, the restored provisions will govern all future nomination processes and party congresses under the Electoral Act.
