2026 Texas Divorce Statistics: Eric M. Willie, P.C. Report
The analysis found divorces fell from 3.8 to 2.7 per 1,000 residents as Texas added more than 8 million people since 2003.
Austin-Based family law attorney Eric Willie released a new analysis showing Texas divorce rates have declined over the past 20 years, despite significant population growth.
While the state's population grew to 30,727,890 by 2023, the divorce rate fell to 2.7 per 1,000 residents, down from 3.8 per 1,000 in 2003.
About 45.8% of marriages ended in divorce in 2023, compared to about 50.7% in 2003, while marriage rates decreased from 7.5 to 5.9 per 1,000 residents.
More couples are living together without marrying, and these cohabitation relationships are not captured in official divorce statistics, potentially contributing to lower recorded rates.
While overall rates have declined, the analysis notes an increase in Gray Divorce among older adults across Texas, involving complex financial and family considerations.
