2 Honduran children detained for nearly a year in migrant facility, ACLU says
The lawsuit says the siblings have been held more than 300 days despite an approved sponsor and completed background checks.
On Tuesday, the American Civil Liberties Union filed a lawsuit alleging two Honduran immigrant children have been unlawfully detained at a Virginia youth facility for more than 300 days.
The siblings fled gang violence in Honduras and remain in the custody of the Office of Refugee Resettlement despite having a fully vetted and approved family friend sponsor.
Federal officials allegedly 'repeatedly' reopened the sponsorship process over minor clerical details, even after confirming 'no documents are pending,' the lawsuit states. The children require 'documented educational accommodation plans and require specialized educational and developmental services.'
Sophia Gregg, an ACLU attorney, stated the ORR is 'choosing to advance the Trump administration' cruel agenda over safe release, while the Department of Health and Human Services declined to comment on the active litigation.
The average stay for unaccompanied minors in ORR custody grew from 30 days in 2024 to 117 days in 2025 under the Trump administration immigration crackdown, a trend this lawsuit highlights.
